Abstract

This chapter aims to reveal and critically analyze the motivations behind the Yugoslavian/Serbian government’s deployment of various paramilitary formations and progovernment militias in Kosovo during 1998–1999. It focuses on the examination of war crimes against civilians, violations of humanitarian law, and breaches of the laws and customs of war committed by these auxiliaries. The chapter delves into the issues of accountability and responsibility for these war crimes, considering the agendas of courts in Serbia and the ICTY. Emphasis is placed on the importance of concepts such as territoriality and extraterritoriality in the context of command responsibility during legal proceedings. Furthermore, this chapter introduces a quantitative assessment of the anticipated level of control exercised over these auxiliaries in the combat environment.
